Hi all,
My client had some funds in a credit union checking account with whom he also had a loan.
After filing for chapter 7, the credit union seized the funds (exempt in the schedules) as an "administrative hold" while they are filing for a relief from stay to claim it as security for their loan.
He was not late on the loan when he filed.
They are relying on two cases:
CITIZENS BANK OF MARYLAND, PETITIONER v. DA- VID STRUMPF (Supreme Court No. 941340, 1995)
MUTHONI MWICHARO, v. WELLS FARGO BANK, N.A., (D.C. No. 2:11-cv-01753- PMP-GW)
Is my client out of luck?
Anyone have case law to rebut?
