Ch13 debt limits and student loans
As Christine aptly points out, there aren't likely to be any from
this group. I've had many potential clients who haven't been able
to file Ch. 13 in part because of S/L debt, but they can't afford
Ch. 11 (nor would it usually make any sense to try and deal with the
absolute priority rule and creditor voting). I don't retain
information of those who don't hire me, so I can only provide
anecdotal evidence. I'm happy to submit an amicus declaration
though...

I would love to ask for an increase for this purpose. Another reason they
won't go into a chapter 11 is due to cost.

The "Court" is writing a law review article to suggest eliminating debt limits from chapter 13 eligibility. The Court is asking the Consumer Bar, if we aware of a debtor(s) who has been denied eligibility, or began by filing a chapter 11 case, because non-dischargeable unsecured student loan debt put the debtor over the debt limit. The Court is specifically looking for a bankruptcy case number.
