Client had previously filed a chapter 7 on 10/7/2009 and obtained discharge on 2/11/2010 we had to file a 2nd bankruptcy for her so we filed a chapter 13 on 4/25/2015 because she would not have qualified for ch7 discharge back then per 727 (a)(8).
She has made payments and is current but would like to convert to chapter 7 and she would qualify under the means test.
1) if I convert to ch7 after 10/7/2017 (8 years per section 727) will ing of the petition date (which was 4/25/15) not the date case was converted? Not sure she can get a discharge!!
2) but if I dismiss ch13 and file a new ch7 after 10/7/2018 it should work but would rather not make her pay for new filing fee and classes etc..
thoughts and suggestions are welcomed
