You will have to check about seeking relief from the stay first in the gmac case. There was something about that last year on this list serve. Check the nacba site too. See the references to rescap. And they should have known better not to have recorded a thing.

I think NACBA got a blanket lify stay order for certain situations.

My debtors are two years into a chapter 13 and had avoided the unperfected mortgage two years ago. Now the avoided mortgage company recorded a lien against the property in violation of the automatic stay and court order avoiding the lien. My debtors had a refinance that was going through and it was stopped because of the recorded lien. Has anyone filed a complaint for damages for violation of the automatic stay?
