Employee filed a state court action against Sole Proprietor for labor code violations. On the eve of trial Sole Proprietor entered into a Stipulated Judgment for the causes of action, but the Stipulated Judgment did not address the statutory attorneys fees that the Plaintiffs attorney would be entitled to. The Plaintiffs attorney could have litigated that issue in state court.
Sole Proprietor then filed a Chapter 13 Bankruptcy and I scheduled the Stipulated Judgment as the amount due the employee in Schedule F. Plaintiffplus attorneys fees. I filed an Objection to the Proof of Claim. What grounds do I have to object to the attorneys fees?
