Folks:
Please don't let this and the other victories on the Addendum go to
waist. I urge you to use the Addendum and fight back when they object to
confirmation. We have done a lot of the work for you. Please take
advantage. File Motions to Request OSCs for compliance with the
confirmation order. Your clients will get monthly statements which will
make it easier for them to keep on tract. There may be a cost to the
client but it should be nominal. The court stated in its decision that
the amounts stated by the servicer ($75-$100) were unsupported. In
reality, they have data mining programs that retrieve this information
in less than 30 seconds. Challenge the servicer. And if I cannot
convince you to use the Addendum at least acquaint yourself with the new
bankruptcy rules 3001(c) and 3002.1. Our take is that the new rules do
not make the Addendum superfluous. I posted a tentative on this exact
issue by Judge Houle that states the same.
