Hi Jeff,
Save yourself a lot of time/money and call the Trustee and have them fax
WF a release letter and WF will unfreeze the account. Per Alberta
Stahl, most trustees will accommodate this request. Mwangi is a loser
(at least in Judge Russell's Court) and I believe it has been overturned
in District Court (need to verify). If you have to file a motion be
prepared - WF is very aggressive. They filed a 38 page response in my
case and sent two big guns from Pillsbury Winthrop to the hearing. They
have significant case law in their favor.

I have Mwangi v. Wells Fargo, *432 B.R. 812 (9th Cir. BAP 2010),
*but I thought this had already gone to the 9th Circuit and was
affirmed. Can't find it at the moment.

I thought we were past the "administrative freeze" horse manure tactics by WF. Apparently not, as it happened to a client today. I also thought there was a 9th Cir. case that was shared on this site that addressed this ans said it was improper. Has something changed since the inauguration?
If anone can recall the name of that case it would sve me a few miutes of sifting through old posts.
