As long as the state court action remains active (i.e., pending) and legitimately concerns real property, the fact that the lis pendens remains on record is not improper; it merely maintains the status quo, much like maintaining a lien, or the action itself. The purpose of a lis pendens is simply to give notice of an action pending that could affect title to or an interest in real property. There is no affirmative obligation to withdraw the lis pendens anymore than there is an obligation to dismiss the action.
