Collection agency threatening to send "driver's license suspension
Debtor was in a car accident while driving her mother's car. Debtor did not
have insurance. Other party's insurer paid for other party's damages. Other
party's insurer sent the bill to collections. Collection agency is sending
collection notices to debtor with a threat and a copy of a "Driver's
License Suspension Request" to be sent to the California DMV if debtor
doesn't pay. Is this legal? Can debtor's license be suspended for not
paying this bill? It's from Recovery Partners, LLC.
According to the CA DMV, a driver's license can be suspended for not having
insurance and getting into an accident, however, is this "threat" from the
collection agency a violation of the FDCPA? It comes off like a shakedown.
