Removing a case to federal court and attaching original pleadings -
I'm in Idaho state court here. Client got sued on a personal guaranty. I am
removing it to fed court under diversity jurisdiction. I just noticed that
the plaintiff attached a document with my client's full social security
number, without redacting.
I am obligated to attach the original pleadings to my notice of removal of
the action, but obviously I want to redact this. What is the best way to
indicate that I am redacting this because the plaintiff failed to? Should I
just indicate it in my cover page? i just want it to be clear that I have
altered the original papers.
Also, has anyone gotten damages from a plaintiff for failure to redact
private info like this? Any guidance is appreciated.
