Lawyers: Should I agree to have a federal magistrate judge hear and enter
final decisions in a case I removed to federal court? This is in Idaho. My
client got sued in state court. I removed it to federal court on diversity
grounds and am seeking to dismiss it for lack of personal jurisdiction and
for improper venue/forum non conveniens. I know in BK court all our cases
are "referred" to the BK judge from the federal judge but I've never
worried about that. But I have not dealt with referrals to magistrate
judges.
This is a straight breach of contract case. He'll need to decide the
MTD/forum nonconveniens issue. The court sent us a request to agree to the
magistrate judge. We don't have to agree to it. They said their federal
judges are busy with their felony criminal cases. I am thinking I should
agree, but what say you?
