Ch. 13 Motion For Authority to Enter Into Loan
Workaround is: Voluntarily dismiss your debtor's case, I just been snowballed by Ocwen, they are not budging in learning that Judge Klein does not approve a loan modification and threatened to deny the completed loan modification. Debtor will get his loan Mod recorded upon dismissal of Debtor's case. There is no law requiring Judges to approve Loan Mods, but Ocwen does not get it or does't care. I spend days arguing to India representatives and US State representatives of Ocwen. Any Ocwen Lawyers out there?Good LuckAxel

That was my understanding as well. Anybody have a workaround? This is a huge difference for the debtors in this case (about $50,000 in arrears!)

Typically our Judges will not approve a proposed modification. g proof that the Court was aware of the pending modification, not that the court approval is necessary. Sorry I can't be of more help.

Thanks, but that LRF deals with the automatic stay and entering into loan mod discussions with the debtor. We're WAY past that.yments. They're now balking on it becoming "permanent" without a court order. This isn't an automatic stay issue. I don't know what their issue is, and I don't know what to file, especially in Judge Zurzolo's court.
