The Judges do not need to sign because the attorney is saying that the reaffirmation agreement is not a hardship. The attorney is assuming the liability. Is that what you want? Also, I believe some Judges review the Reaffirmation Agreements even when the attorneys sign off. This is a great question to bring up at the next CEB because the Judges will be there.

But the Judge need not approve it if the attorney signs it and it simply gets filed. I got a motion to reopen a discharged 7 granted today - though the Judge took many days to enter it.

Clients do not need to sign reaffirmation agreements. Even the Judges frown upon reaffirmation agreements on Home Mortgages. This is reminiscent of the Sears strong arm tactics back in the 90's. Strongly suggest we help our clients find other lenders. Doesnt it make you nervous to sign off on a clients reaffirmation agreement for a mortgage?
