I have a case in front of Judge Russell where my clients "completed" credit
counseling before filing their case but the certificate was not issued
until after the case was filed. Most likely because they did not click the
final few buttons to have the certificate issued.
Since there are so many other compliance issues, I am considering a
stipulation to dismiss the case. If we decide to dismiss, I would prefer
the judge to strike the petition in lieu of dismissal.
Judge Russell did not join the conclusions of law in Manalad (60 BR 288) so
my question is, does anyone know his position with respect to credit
counseling?
Sincerely,
