Judge Zurzolo stated in court at his last confirmation hearings that the
proof was not required. Nancy was appearing for the hearings. So she
heard him tell everyone that they need not attach proof. I sent an email
to Masako and she verified that they are no longer looking for the
proof.

I spoke to Melissa Besecker recently about mortgage declarations and the local bankruptcy rules. She verified that at least in the Valley and SB all of the judges are going along with the new local rules regarding the mortgage declaration. There is no need to attach proof of payment and mailing unless otherwise specified. In addition, she wanted everyone to know that mortgage declarations must be cummulative as of the date of filing. She stated that many of you are still attaching the proof or are not filing cummulative mortgage declarations. So please make the adjustments in your practice.
