Here's a question for the experts who are familiar with judicial
preferences.
California Central District. Chapter 13.
A credit union second mortgage on the home is partially secured. The
credit union mortgage extends the lien to the credit union shares (in
addition to the residence). We need the court to make a determination that
(based on the documents) additional collateral takes the mortgage out of
section 1325 protection.
Would Judge Zurzolo want in this situation a motion or an adversary?
