See Section 1328(f). Since your client received a chapter 7 discharge in a case filed within 4 years of the present chapter 13 filing, he is not entitled to a discharge in the current Chapter 13 case.

I have a notice on a Chapter 7 that I filed earlier this week which is described as a Notice of Debtors Prior Filing, referencing the clients prior filing in 1997. I assumed that this is just a new automated notice that docketed prior cases involving the same parties.

I set him up on payments he could afford for 5 years, after which he planned to retire and work out different arrangements based on his future lower stream of income. I received a NOTICE OF NON-ENTITLEMENT TO DISCHARGE from the Court. It states that this new case will be closed within 10 days (citing code section 350) unless I file an objection and request for hearing. I have never seen nor heard of this procedure. Can anyone enlighten me?
