FYI: Judge Brand stated in open court last week that in her court
the absolute priority rule DOES apply in individual cases. She has
not actually ruled that way--yet--but stated it orally when
assessing the viability of a proposed plan at a relief from stay
hearing.
Anyone keeping a tally on which judges are following the Friedman
case and which ones aren't?
