Should Stay Be Lifted
Creditor wants stay lifted to enroll its breach of contract judgment (there was
a jury verdict, but no judgment as of the date of the Chapter 7 filing) ?
Debtor does not want a postpetition judgment entered because of potential future
credit nightmares. This is an asset case. Both the trustee and I have offered
to allow the creditor to file its Proof of Claim in the amount of the verdict,
but it refuses and wants to enroll the judgment. Is Judge Kaufman likely to
allow the creditor to do so over our objection?
