Definition of Pending under 11 U.S.C. Section 341(c)(4)(A)

Debtor in new Chapter 13 case. One prior Chapter 13 case dismissed within last year. 2nd prior Chapter case closed within last year, but dismissed more than one year prior to current case.
Was the 2nd prior case pending within the year before the current case? I could not find any case law on point. Rutter Group BK treasties speaks in terms of dismissal and that would be my inclination, but being a Chapter 13 case, a Chapter 13 Trustee's final report filed, so it seems that something was still pending in the 2nd prior case within the last year.
Thoughts?
