I have a chapter 13 debtor who has a contracting business where he works for
a large property management company and has very stable income. He
occasionally uses sub- contractors, but otherwise has no employees. The
business is a d.b.a.
I am comfortable enough with the income stability to advocate a chapter 13
plan. I have a CPA generated P&L etc. My question is; does the client need
to have his contracting business set up as a corporation or LLC? My
experience with the Ch7 trustees is that properly insured dba businesses are
not a problem. Assuming the income issue is satisfied, will the ch13 work
with a self-employed dba? The filing will be in the ND and the trustee will
probably be Rojas. We have time to set a corp up if necessary.
