Here is a new scam for you to worry about. Apparently someone is scanned
PACER looking for adversarial proceedings from creditors and calling the pro
per debtors and asking if they would like to settle for mere pennies on the
dollar.
The case that came to my attention was a credit card company with a $25,000
claim against the debtor (who had apparently charged non-dischargeable taxes
on the oh-so-dischargeable credit card). What was described to me was that
a very nice lady called them and offered to settle the adversarial
proceeding for 2% of the outstanding claim or $500. As a matter of fact,
this nice lady was so sweet, she could take care of it right away if they
would just turn over their bank account information so she could make sure
the payment was applied right away and then no one would have to go to the
upcoming hearing.
The debtors are thinking "2%? Wow, we would have paid 10%!!" What a great
deal! Of course, it is a scam. The very nice caller has nothing to do with
adverse proceeding. The debtors do not appear at the hearing and things
just unravel from there.
