Bankruptcy/Family Law Crossover question
I have a weird Chapter 7/Family Law crossover question. I have a PNC with a
horrible ruling from the family courts, which among other things, values the
marital home very low, and gives it to husband at that low value. Wife got
left with support and a few other assets. There is tons of community debt.
If Wife files for a Chapter 7, with the Chapter 7 bankruptcy trustee
liquidate the marital home at the FMV to satisfy the creditors? I have seen
the cases about marital settlement agreements (i.e. Mejia v. Reed, In re
Carbaat, In Re Beverly) but want to see if anyone has seen anything where
there is a contested trial.
Wife has ruling only, no judgment yet, if that effects your analysis.
