Dear Members:
Question came up today with Chapter 13 Trustee who claims that Adult kids
living in home attending school who have no income cannot be counted as a
member of the household for purpose of determining whether the Plan must be
a 3 year or 5 year. But these cases say otherwise and comport with my
understanding of functioning as one family unit. This would mean that
adult children in college being supported by parents who live more than 6
months in home, are IRS dependents and as such can be counted as member of
household. Trustee says no. Only can be counted if old/disabled. Am I
missing something?
