Your client should state that he keeps track of prices in his neighborhood
and in his opinion the FMV of his house is X. This is admissible, but not
terribly weighty. If there is opposition offering weightier evidence, you
would want an appraisal to make your case.

I'm not sure about #1, but pretty sure about all the others;
1. I don't believe so. He cares about the weight of evidence, and
whether he qualifies as an expert. Remember you have to lay the
foundation for all expert testimony. Judge Z attended a CDCBAA seminar
where he addressed these exact kinds of questions a few months back.
However, if your broker can qualify as an expert, maybe he'll give him
credence.

This is a question from a colleague, and I would appreciate any insights
that you may have:
1) Does Judge Zurzolo accept a Broker Price Opinion (with declaration by
the broker) as evidence of value for the purpose of lien stripping, or does
he require an appraisal?
2) How does the lien stripping adversary affect confirmation? Does the
confirmation hearing just get continued until there is a disposition in the
adversary?
3) Does Zurzolo require the second to be current (like EC), or does he
grant motions to suspend payments on the second?
