First of all I am not normally a crusader but;
I took a call from a confused potential client yesterday. PC's Initial
inquiry was how could she save her 8 unit rental property from foreclosure.
She told me she had filed a bankruptcy last year, but it was dismissed. She
wasn't clear what her attorney had done and the story she told did not make
any sense so I pulled her case up to take a quick look. WOW. Handwritten
schedules, most schedules were blank, missing information, a negative I-J,
this was a chapter 13 and she was over the 109(e) limit for secured debt.
The amended schedules were also mostly incomplete. I volunteer at Woodland
Hills help center and these attorney prepared forms were worse than any pro
per I have seen. This appears to be the only bankruptcy case the attorney
filed in the CDC. No show at the confirmation and Nancy Curry had the case
dismissed on 5/12/2010.
I'm not to the outrage part yet. Client said that "technically" she had
lost her home in foreclosure but her bankruptcy attorney was suing for
wrongful foreclosure based on lack of notice. I asked if she had received
notice of default or if notice had been posted on the door, and she didn't
know because she wasn't living in the house, her bankruptcy attorney who was
also her tenant was living in the home. She believes her tenant/attorney
ignored the notice.
Outrage, what to do? Potential client lives in Downey, does anyone want
the referral?
