The fact of the matter is that the Means Test captures a lot of mental
energy and therefore has its own gravitational pull. We have all felt
it.

Hah! I am glad I'm not the only one. As long as the dullness passes like
gas, I guess we're not too bad off, but it's still embarrassing to have
those moments.

The first question is: "Is this a consumer debt?" If not, then the means
test doesn't apply. I know this. I swear I know this. For some reason, I
forgot this temporarily, and a couple weeks ago I sent away a very
nice client because he didn't "pass the means test". Then it hit me out of
the blue yesterday - "oh, crap; that was all nonconsumer debt". So I
emailed him. Sure enough, he had contacted other counsel and found out he
could file a chapter 7 after all; he hired that counsel who proceeded to
settle the matter without the bk. I could have done that. What was I
thinking?? Doh! Moron.
