Need advice on what to do after getting skeletal ch. 13 filing
I think I'm in hot water and need advice. I filed an emergency chapter 13
bankruptcy for a client in order to stop a foreclosure sale. Somehow, I
miscalendared the deadline to complete the filing, and I just received a
notice of dismissal.
What are my options at this point, if any? I know I can refile, but it will
require a motion for automatic stay since the dismissed bky was client's
second filing (he had filed once before on his own.) Is there a realistic
chance of success in filing a motion to vacate the dismissal based on my
miscalendaring? If so, does anyone have a sample that I can use as a
reference?
