Judge Tighe was involved as a OUST counsel on a couple 18 USC 152 "false
oath" cases involving Social Security numbers where the Ninth Circuit Ct of
Appeals found against the debtor. See Clymer (95-55941) and Welch (103 F.3d
906). Sentences range from 15-33 months. Hale

Hi:
Many years ago, I had a client who came into my office and told me that
he wants to file for bankruptcy. He told me that he did not work for six
years. I did not believe any one can survive for six years without any
income. After talking to him for a little while, he told me that under his
own identity, he did not work but he worked under other identity (ie another
SSN# and name). Both the SSN and the CA ID will bought. He told me he had a
total of five different identities (ie five different sets of SSN# and ID
card). That reminds me of the movie Bourne Identity. I then told him that
I am so confused with his identity that I have a headache. I did not take
the case. Too much problem.

I had that happened to me. AFTER we filed, debtor tells me that the social security card he has been using is not really his! We just filed a declaration that the debtor does not have a social security number. No problem. But I would be weary of a creditor filing a 523 motion based on fraud....I would think. Not to mention the fact that the debtor will be testifying under oath that he does not have a social security number but yet has been working, presumbaly in violation of immigration laws, etc...Didn't happen in my case but I don't think I would want to risk that in the future.

Marvin:
Thank you for sending me a copy of the Perez case. The facts of my case are
about as close as if I represented Perez. The decision says it all. I will
not be filing the case.
