Divorce orders PNC to pay ex spouses attorney fees
Shannon, et al.:
It is more complicated than that. While generally fees payable to opposing counsel in a divorce jmt or marital settlement agreement in CA are for in the nature of support and thus non-dischargeable under (a)(5), it is imperative to review the jmt or MSA. Courts can order fees as sanctions based on bad behavior in the litigation. These fees are not covered by (a)(5) or (a)(15) and are dischargeable unless covered by another exception.
Additionally, atty fees could be ordered or agreed to as part of a property division. In that case, they would be dischargeable in Ch 13.
