Suggestion:
We [one of our esteemed and experienced colleagues] take the issue on
appeal. We all know that Riverside has a fixed rate for such work and some
judges in other divisions ask for motions, while others require adversary
proceedings.
If our fees are "reasonable" then they should be approved. I look forward
to increasing my fees comensurate with my expertise and experience.
Just my thoughts.

Jason:
That is my read also. As an example, the RARA is not an agreement amongst
us, but a price at which the court will not question us. It can be argued
that it causes fees to go up to that level, but anyone who has handled an
individual with a small business knows what that the RARA did not make the
price go up.
I sent my request to three national listserves. If I get anymore, I will
pass it on.
If you have any questions or concerns, please contact me.

Patrick: Thank you for that article which was pretty much, right on the money. Maybe the clerk's office or one of the trustee's collects this information. I bet they do.
So, exchanges of information on fees between competitors is problematic, even if consumers could do the same survey, with names and amounts.

Dennis and Jason:
I am only reporting what has come up on every other Listserve I am on where
fees have been raised. The issue is one of an anti-trust and price fixing.
I know next to nothing of the law in this area. If you have a working
knowledge of antitrust law, then please let us know and give chapter and
verse to show me that my concerns are unfounded. If you don't have working
knowledge of the area of law, then I believe your confidence is misplaced.

I don't see the problem either. Is the no-look fee and the RARA terms antitrust violations?

To get around that, it is fair to ask how much time is spent on a typical adversary or motion and what factors make that estimate go up or down. This will not run afoul of anti-trust rules, but will allow us to know what we are up against.
