To Be or Not to Be? (Newbie Question..)
Stephen,
Totally from the hip here...but there is a 6 month tolling from the date of filing of the petition, right? Maybe they will not be divorced by the 341?

The Chapter 7 could be filed before that date, but they will likely be legally divorced before the Creditor's Meeting. Is the filing date the tail ht wags the dog or the divorce before discharge, and does this impact the right for the joint petition filing?

Termination of status date and bk filing date are the two critical dates.
Nothing else matters.

Clients, H & W, want to file Chapter 7 BK. However, they already filed for
divorce and a hearing to bifurcate the divorce to allow for dissolution is
set for August 23. The Chapter 7 could be filed before that date, but they
will likely be legally divorced before the Creditor's Meeting. Is the filing
date the tail ht wags the dog or the divorce before discharge, and does this
impact the right for the joint petition filing?
