Caroline,
In ten years and a few hundred Ch. 13's, I've never seen a Ch 13 Te force a debtor to retire. Remember, Ch. 13 is a WHOLLY VOLUNTARY CHAPTER. If ever your client is not satified with the course of the case, he/she may simply voluntarily dismiss it.
I've had plenty of cases where Ch. 13 Debtors where working two jobs but shortly before filing, quit one of them. I've haven't seen a Ch. 13 Te that would demand that the debtor get back that 2nd job or take another 2nd job!

Would the trustee require that the debtor take the "voluntary retirement" even though it is less than it would be at age 65 but more than what the person is making at the person's current job? Thank you. CF

Has anyone had a case where the debtor could choose to retire, say at age 55 or younger, and then filed a Ch 13.
